In the course of your purchase from House and Extension Plans, you will be required to click the check box

marked “I’ve read and accept the terms of service” to confirm your acceptance of these

terms. If you don’t accept these terms, you will not be able to avail of a service from

House and Extension Plans. Please download and print a copy of these terms for future reference and we

Policy before making a purchase.

2. How the Contract is Formed Between You and House and Extension Plans

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of

your order. A contract between you and House and Extension Plans will only be formed when you have made payment.

The contract is covered by Irish and European Law.

In the unlikely event that the service is longer available, or that we have made a pricing mistake, we will advise you of this. You will have the option of a full refund at this point and there will be no contract between us.

In order to contract with House and Extension Plans, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to our payment provider. House and Extension Plans retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm our identity. Where a contract is made with a third party, House and Extension Plans is not responsible and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply

you.

3. How to Place an Order

Place your order by selecting the steps you wish to buy (e.g floor plans & site layout), uploading your documents (rough drawing and walk-through video) and filling out required fields (property owner name, address, notes and filling out billing details. A “step” refers to any selection you make be it singular or in combination with other selections. Different options are presented as checkboxes with descriptions of what’s included.

An order is placed when you proceed through the checkout process and click pay with stripe. You will be brought to a page confirming your purchase, and an email will be sent to you confirming order.

A member of our team will review your documents and once satisfied that the job can be fulfilled, we will initiate the next phase and proceed with your project. We use a secure payment provider, Stripe.

Stripe has been audited by an independent PCI Qualified Security Assessor (QSA) and is certified as a PCI Level 1 Service Provider. By using Stripe, you are agreeing to their terms of service (https://www.trustap.com/terms)

You can pay for your

order by Visa, Mastercard or American Express or Apple Pay.

All prices quoted on our website are in Euros and include VAT at the current rate. Promotional prices only apply during the period stated.

Please contact House and Extension Plans using the details at the

top of this page immediately if you wish to change your order. Most orders are processed within 24 hours after payment into escrow account.

When placing an order you undertake that all details you provide to us are true and accurate,

that you are an authorised user of the credit or debit card used to place your order and that

there are sufficient funds to cover the cost of the goods. All prices advertised are subject to

changes without notice.

4. Delivery of service

We aim to process your order within 1 full working day of your payment. If your order is likely to be delayed, we will contact you. If you have any queries regarding your order, please contact House and Extension Plans using the details at the top of this document.

Upon completion of final set of plans and/or planning application is lodged, House and Extensions Plan are obligated to continue working on your behalf as agent and are responsible for the following:

1. Processing, replying to and amendment of plans in relation to Further Information Requests by Local Authority

2. Payment of Local Authority Fee

3. Send email including print off version of site notice and instructions for erecting site notice.

4. Send email including commencement notice if included in package.

5. Refunds Policy

Whilst we hope you will be fully satisfied with the service, if you are not satisfied with our service within reason, funds will be returned to you which will take no longer than 5-working days.

House and Extension Plans reserves the right to dispute unwarranted and unjustified claims by the customer that a satisfactory standard of service is not met.

Following the production of revised plans and/or planning application has been lodged, it will stand that a satisfactory level of service has been provided and no refunds will be possible past this point except under exceptional circumstances. We will endeavour to adequately respond to any further information requests. However, a planning permission refusal will not automatically warrant a refund. House and Extension plans will not be liable for refusals, but will work on your behalf until a decision is made by the local authority.

We will process any refund due to you as soon as possible.

6. Use of plans

Plans and drawings produced by House and Extension Plans shall not be used by the customer or any other party until full payment has been made. The plans remain the intellectual property of House and Extension Plans until funds have been made payable to House and Extension Plans. To use the intellectual property without making full payment shall be a breach of these terms and an infringement according to copyright and consumer law.

7. Our Liability

We warrant to you that any service purchased from us through our website is the highest

quality and reasonably fit for all the purposes for which services of its kind are commonly

provided.

We will not accept liability for any direct, indirect, special, consequential, punitive or incidental

damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or

reputation, or the cost of procurement of substitute services, arising out of or

related to the use, inability to use, performance or failures of House and Extension Plans .

Our liability to you (whether in contract, tort (including negligence) or otherwise) is limited to

the purchase price of the service you purchased.

Nothing in these terms limits our liability for death or personal injury caused by our negligence

or for any other matter for which it would be illegal for us to limit, or attempt to limit, our

liability.

8. Written communications

Applicable laws require that some of the information or communications we send to you

should be in writing. When using our website, you accept that communication with us will be

mainly electronic. We will contact you by email and whatsapp or provide you with information by posting

notices on our website. For contractual purposes, you agree to this electronic means of

communication and you acknowledge that all contracts, notices, information and other

communications that we provide to you electronically, comply with any legal requirement that

such communications be in writing.

9. Events Outside of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any

of our obligations under a Contract that is caused by events outside our reasonable control

(Force Majeure Event).

A Force Majeure Event includes any act, event, omission or accident beyond our reasonable

control and includes (as well as others) such things as: terrorist attack, fire, food or natural

disaster, epidemics, impossibility of the use of means of public or private transport, or public or

private telecommunications networks or the threat of any of these things.

Our obligations to you under any Contract are deemed to be suspended for the period that the

Force Majeure Event continues, and we will have an extension of time for performance of our

obligations for the duration of that period. We will use our reasonable endeavours to bring the

Force Majeure Event to a close or to find a solution by which our obligations under the Contract

may be performed despite the Force Majeure Event.

10. Other Matters

If we fail to exercise any of our rights under any Contract, this will not amount to a waiver by us

of those rights.

If any part of these terms or of any Contract is unenforceable, this will not affect the

enforceability of any other part.

We intend to rely upon these terms and any document expressly referred to in them in relation

to the subject matter of any Contract.

These terms, together with any document referred to in these terms, constitute the whole

agreement between you and us.

11. Changes

We may revise these terms of use at any time by amending this page. You should check this

page from time to time to take notice of any changes we have made, as they are binding on

you.

Any Contract will be subject to the terms in force at the time that you order products from us,

unless any change to these terms is required to be made by law or governmental authority (in

which case it may apply to orders previously placed by you).

12. Law & Jurisdiction

These terms and contracts for the purchase of products and services through our website are

governed by Irish and European law. Any dispute over or claims arising from these terms or any

contracts will be subject to the exclusive jurisdiction of the Irish and European courts, although we retain the right to bring proceedings against you for breaking these terms or any contract in

your country of residence or any other relevant country.
